LOUIS J. CAPOZZI, JR., ESQUIRE
Mr. Capozzi was also employed as the Director of Healthcare Appeals at Zelenkofske Axelrod and Company, where he litigated Medicaid and Medicare reimbursement, corporate compliance and labor issues, having presented many seminars for PANPHA, PACAH, PALA and PHCA. He was also selected by the Pennsylvania Institute of Certified Public Accountants to provide a legal update to its members at their 1994, 1996, 1997 and 1999-2003 annual meetings. He spoke on employee manuals and labor law issues at the 1996 and 1997 annual meetings of the New Jersey Association of Non-Profit Homes for the Aging, provided a labor and employment law update at the 1995 meeting of the Pennsylvania Chamber of Business and Industry, and presented a Managed Care and Maryland Medicaid reimbursement seminar on behalf of the Maryland Association of Non-Profit Homes for the Aging in December 1996. Mr. Capozzi has also spoken on behalf of the American Lawyers Association and on behalf of the American Bar Association. He is a member of the faculty of Slippery Rock University and serves as an Arbitrator for The American Health Lawyers Association. Mr. Capozzi was selected by PANPHA to provide Corporate Compliance Programs to its members, and was lead counsel on a class action lawsuit against the Pennsylvania Department of Public Welfare which resulted in a $151 million settlement to non-county homes. He is a member of the Pennsylvania, Maryland and New Jersey Bars and is admitted to practice before the Federal District Courts for the Eastern, Western and Middle Districts of Pennsylvania, the Third Circuit Court of Appeals, the Pennsylvania Supreme Court and the Federal Districts of New Jersey and the District of Columbia. DANIEL K. NATIRBOFF, ESQUIRE
Mr. Natirboff has participated in the Dauphin County Pro Bono Program and the Federal Pro Bono Attorney Program for the Middle District of Pennsylvania where he has represented indigent litigants in State and Federal Court including Federal Jury trials. Mr. Natirboff came to Capozzi and Associates from the Pennsylvania Department of Public Welfare where he was employed as an Attorney Hearing Officer conducting formal hearings and drafting adjudications in the area of Medical Assistance. Mr. Natirboff has authored articles on legal issues relevant to nursing home providers which have been published in Nursing Home Trade Association publications nationally, including the Pennsylvania Association of Non-Profit Homes for the Aging's (PANPHA) legal briefs and is a frequent speaker at seminars on Long Term Care issues. Mr. Natirboff is a member of the Dauphin County Bar Association, the Pennsylvania Bar Association, and Business Member in PANPHA and the Pennsylvania Health Care Association (PHCA). He has served on the PA Bar Association Health Law Committee, the PA Association of Home Health Agency's Finance Committee, the PHCA Government Funding Relations Committee, the Payment for Services Committee and most recently the Local Advisory Committee. Mr. Natirboff's other experiences include employment with the PA Liquor Control Board and the United States Department of State at the American Embassy in Moscow. DONALD R. REAVEY, ESQUIRE
Mr. Reavey also focuses on real estate tax assessments for "non-profit" and "for-profit" facilities and has been successful in reducing a health care providers' real estate tax liability on appeal. Mr. Reavey also oversees all collection and guardianship actions initiated at the firm. He is the architect of the current legal theories employed by Capozzi and Associates against powers of attorney for the misappropriation of the assets of their elderly charges and for their failure to assist the State of Pennsylvania with the Medicaid application process. In addition, Mr. Reavey has been successful in assisting health care facilities in obtaining licensure from the Department of Insurance to operate as Continuing Care Retirement Communities. Mr. Reavey is a frequent speaker on healthcare reimbursement and taxation issues, having presented seminars for PANPHA and seminars for nursing home administrators. Prior to joining the firm, Mr. Reavey defended physicians from false medical malpractice claims. In addition, Mr. Reavey served a two year term as a judicial clerk to the Honorable John W. CRAIG I. ADLER As a partner in the law firm of Adler & Adler, Mr. Adler focuses on real estate matters representing area builders, developers, realtors, banks and home purchasers and sellers. As part of his practice he represents various parties before local municipalities in obtaining approvals for zoning changes, zoning variances, subdivision approvals and land development plan approvals. As an associates with Fox, Rothschild O'Brien and Frankel, he concentrated his practice in commercial real estate, representing clients such as The Pep Boys, Manny, Moe & Jack and Metrophone (now Comcast). The practice revolved around acquisition and development of properties, and leasing of sites for cellular telephone towers. BRUCE G. BARON, ESQUIRE
Mr. Baron also worked for eleven years at the Pennsylvania Department of Public Welfare (DPW), specializing in MA Program enforcement and nursing home reimbursement matters, as well as contract administration, including implementation of Nursing Home Reform Law requirements and of DPW's Medicaid Provider claims processing and eligibility information systems (MAMIS and CIS). From 1990 to 1997 (when he joined Capozzi and Associates), Mr. Baron worked as an independent research and reimbursement consultant for attorneys, accountants and Pennsylvania Nursing Homes, specializing in Medicaid related matters, including the development of bridge financing for nursing facilities during the State budget lapse. He has made many presentations on Pennsylvania Nursing Home reimbursement issues and the Government's role in health care policy, regulation and reimbursement, including conference materials available through the Pennsylvania Bar Institute and sponsoring associations. ANDREW EISEMANN , ESQUIRE
Mr. Eisemann writes and lectures on subjects related to collections and the management of Accounts Receivable for long-term health care facilities. Mr. Eisemann was previously an Attorney at the Law Office of Markian R. Slobodian, Harrisburg, where he practiced in civil litigation, creditors' rights, and collections in state and federal courts. He also represented numerous creditors, debtors and Chapter 7 Trustees in Bankruptcy Court. He also previously served a two-year term as a Law Clerk to the Honorable Edward Guido of Cumberland County. Mr. Eisemann is a Lieutenant Colonel in the Army Reserve with 26 years of Regular Army and Active Reserve service in Special Operations and Field Artillery, including multiple deployments overseas and a recent tour to Iraq as a military advisor to an Iraqi Army Division staff. He is admitted to practice in Pennsylvania state courts, the U.S. District Courts for the Middle District and Eastern District of Pennsylvania, the U. S. Bankruptcy Court, and the U. S. Court of Veterans' Appeals in Washington, D.C. He is a member of the Pennsylvania Bar and the Middle District Bankruptcy Bar Associations. He serves as the Chairman Emeritus of the Military and Veterans' Affairs Committee of the Pennsylvania Bar Association. MICHAEL M. JEROMINSKI, ESQUIRE
Mr. Jerominski also has experience in Bankruptcy Law, Commercial Litigation, Contracts, Appellate Practice, Municipal Law, and Mental Health Procedures Act litigation. Before coming to Capozzi and Associates, Mr. Jerominski was an attorney at the firm of Foreman, Foreman & Caraciolo in Harrisburg, where he focused on civil litigation. DAWN L. RICHARDS, ESQUIRE
Throughout her years as Chief Financial Officer she developed and implemented hospital compliance programs in the areas of billing, physician contracts, managed care payments, HIPAA, Sarbanes-Oxley, system security and EMTALA. In 1995 she was part of the management team that established Prime Holdings, Inc, a managed care organization in Las Vegas, NV.Her responsibilities included provider contracting, premium billing, capitation, risk pool development and underwriting. Prior to joining Capozzi and Associates, Ms. Richards practiced law in Pottsville, PA. Her practice included physician representation, Medicare appeals, Chapter 11 bankruptcy, business law, taxation and guardianship. She developed a Spring Law Series for Diakon, offering free legal education for the senior community at county senior centers. Her education includes a Bachelor of Science in Accounting from the University of Las Vegas, Nevada (Cum Laude 1991), a Masters in Business Administration from the University of Las Vegas, Nevada (Cum Laude, 1995) and a Juris Doctor from Temple. She served in the United States Army from 1983 until 1989.
